An annulment of marriage is a legal process that declares a marriage null and void.

​For non-Muslims in Malaysia, annulment is governed by the Law Reform (Marriage and Divorce) Act 1976 (LRA 1976) and must be filed at the High Court of Malaya.

Unlike divorce, which ends a valid marriage, annulment establishes that the marriage was either never valid (void) or valid until annulled (voidable). ​Under the LRA 1976, either husband or wife may file a petition to the court for a decree of nullity in respect of the marriage.


​Grounds for Annulment of Marriage in Malaysia

1. Void Marriages (Section 69, LRA 1976)
These marriages are invalid from the very beginning. A marriage is automatically void if: -
  • One party was already lawfully married at the time (bigamy).
  • A male under 18 or a female under 16 marries without special licence.
  • The parties are within prohibited degrees of relationship without approval.
  • The parties are not respectively male and female.

2. Voidable Marriages (Section 70, LRA 1976)
These marriages are valid until a court declares them void. ​A marriage may be declared voidable if: -
  • The marriage has not been consummated due to incapacity.
  • The marriage has not been consummated due to willful refusal.
  • Consent was not valid (duress, fraud, mistake, unsoundness of mind).
  • A party suffered from mental disorder at the time of marriage.
  • A party was suffering from venereal disease in a communicable form.
  • The wife was pregnant by another man at the time of marriage.

3. Bars to Annulment (Section 71, LRA1976)
Annulment is not automatic. The court examines fairness and conduct. This means that even if grounds exist, the court will not grant annulment if: -
  • The petitioner misled the respondent into believing the marriage would continue.
  • Granting annulment would be unjust to the respondent.
  • The petitioner knew of the respondent’s mental disorder, venereal disease, or pregnancy (at the time of marriage).

  1. Consult a Family Lawyer: Assess whether your case qualifies for annulment.
  2. File a Petition for Nullity: Petition is filed at the High Court of Malaya.
  3. Court Hearing: Court reviews evidence and hears both parties.
  4. Decree of Nullity: If granted, the court issues an order declaring the marriage void or voidable.

​Q1: How long does an annulment take in Malaysia?
Annulment cases usually take 3-9 months, depending on the complexity of your case, the availability of evidence, and the court’s schedule. Straightforward cases may be resolved faster, while those involving disputed facts may take longer.

Q2: Is annulment easier than divorce?
Not necessarily. Divorce requires proof of irretrievable breakdown of marriage, while annulment requires proof that the marriage was void or voidable under the Law Reform (Marriage and Divorce) Act 1976. In practice, divorce may be more common, but annulment may be appropriate where the marriage was fundamentally invalid from the start.

Q3: Can I file for annulment within 2 years of marriage?
Yes. Unlike divorce (which generally cannot be filed within the first 2 years unless there is exceptional hardship), annulment has no time restriction. You can apply at any time if your marriage meets the legal grounds.

Q4: What if my annulment application is rejected?

Q5: Do I need to attend court for annulment proceedings?

Q6: Can annulment be done online in Malaysia?

  • Void marriage: Invalid from the start (e.g., bigamy, underage marriage without licence).
  • Voidable marriage: Considered valid until the court annuls it (e.g., non-consummation, fraud, duress, venereal disease).

Q8: How much does an annulment cost in Malaysia?

Q9: Can annulment be based on infidelity or cheating?

Q10: Do both husband and wife have to agree to annulment?
Either spouse may file a petition for annulment. However, if the other spouse disputes the grounds, the case may become contested, and the court will decide based on evidence.

  • Identity cards/passports of both parties
  • Birth certificates of children (if any)

Q12: Is annulment the same as divorce?

APPOINTMENT AND DISCUSSION
Upon confirmation of our appointment, we will discuss your matter with you in detail. Once the divorce terms have been agreed, we will prepare the documents and process all the paperwork prior to your signing of documents.​

SIGNING OF DOCUMENTS
After the documents are prepared, usually within a few working days after confirmation of the divorce terms, we will make an appointment with you for the signing of documents. All the terms will be explained to you before signing.​

COURT HEARING
Upon the signing of the documents, we will file the same to the court. The court will process the documents and a hearing date will be fixed. Depending on the schedule of the court, the matter may be fixed for hearing within a few weeks after filing.​

COMPLETION
After the hearing of the matter by the court, we will process the remaining paperwork, which will involve the filing of the court orders and extraction of the same. Thereafter, we will submit the documents to JPN for update of your marital status.​​
