​Understanding the 2-Year Rule in Malaysia

Many people ask whether divorce becomes automatic after 2 years of marriage in Malaysia.

The short answer is no. Divorce in Malaysia is never automatic, regardless of how long you have been married or how long you have been separated.

Under the Law Reform (Marriage and Divorce) Act 1976 (Act 164), section 50 specifically restricts couples from filing a divorce petition within the first two (2) years of marriage, except in cases of exceptional hardship or depravity.

​This restriction often creates the misconception that after 2 years, a marriage automatically ends. In reality, even after 2 years, you must still file a divorce petition in court.


The Legal Position: No Automatic Divorce

  • There is no such thing as automatic divorce in Malaysia.
  • A divorce must always go through the High Court of Malaya.
  • Even if both parties agree to divorce, they must file a joint petition.
  • The court will only grant a Decree Nisi, which becomes final after 3 months when it is made absolute.


Divorce After 2 Years of Marriage

Once your marriage has lasted more than 2 years:
  • You may file for divorce either by joint petition (mutual consent) or single petition (contested divorce).
  • Both spouses must still appear in court (for joint petition).
  • There is still no automatic process, you need to engage a lawyer to draft and file the petition.

If you are looking for a fast divorce in Malaysia, the quickest route is usually through a joint divorce petition. However, you and your spouse must first meet several important requirements. Generally, to file for a joint divorce in Malaysia:-

  1. Your marriage must be registered for at least two (2) years.
  2. Both parties must mutually agree to divorce.
  3. Both parties must agree on child custody and care arrangements (if there are children).
  4. Both parties must agree on how to deal with jointly-owned property (if any).
  5. Both parties must agree on the amount of spousal maintenance (if applicable).
  6. There must be no unresolved disputes or contested terms between both parties.​

Meeting all of these conditions ensures that your joint divorce petition can proceed smoothly and be finalized in the shortest possible time.
