​Frequently Asked Questions

Quick answers to help you make informed decisions.
Q1. How do I file for a divorce? 
In Malaysia, there are generally two types of divorce petition: -
  1. Joint Divorce Petition / Mutual Divorce (where both you and your partner agree to the divorce and the terms of separation); and
  2. Unilateral / Single Divorce Petition (where either you or your partner disagrees with the divorce or any of the terms of separation).

​Q2. Joint Divorce Petition: How and When?
  • ​As long as the joint divorce petition is filed two (2) years after your marriage, the High Court of Malaya may make the order of divorce if both you and your partner freely consent to the divorce, and proper arrangement has been made for the wife and children (if any).

Q3. Single Divorce Petition: Grounds for Divorce?
  • Unlike a joint divorce petition, there must be a proof of irretrievable breakdown of your marriage, that is to say, that there must be proof of commission of adultery by either party; unreasonable behaviour of either party; desertion by either party for two (2) years; or both parties have lived apart or separately for two (2) years.

Q4. ​Is there a reconciliation process before divorce?
  • The law requires couples to first attempt reconciliation through the Marriage Tribunal at the National Registration Department (Jabatan Pendaftaran Negara), before filing for divorce, unless exempted (e.g., in joint petition or in limited circumstances).

Q5. What is the process and duration 
  • The timeline depends on whether it is a joint or contested divorce. A joint divorce may take as little as 3–6 months, while a contested case can stretch beyond a year.

Q6. ​What documents do I need to file for divorce?
  • Common documents include original marriage certificate, birth certificates of children (if any), NRIC/passport copies of both parties, relevant financial / property documents. Your lawyer will advise you based on your case.

Q7. When may you remarry?
  • You may remarry if you so wish after your marital status in the record of National Registration Department (Jabatan Pendaftaran Negara) has been updated. 

Q8. What are the consideration for couples with children?
  • ​For couples with children, proper arrangement must be made for the support, care and custody of the children.
  • It is strongly advisable for couples with children to discuss about the arrangement for the children.
  • If you are unable to agree to it, the Court may decide on the matter having regard to the wishes of the parents (if any) and that of the children (if they are able to express independent opinion).

Q9. ​Is there a waiting period before I can file for divorce?
  • ​Yes. You generally need to wait at least 2 years from the date of marriage before filing for divorce, unless you obtain special court permission due to exceptional circumstances.

Q10. Do I need a lawyer to file for divorce?
  • ​Divorce must be filed through the High Court in Malaysia. Having a lawyer ensures the petition is properly drafted and that your rights on custody, maintenance, and property division are protected.

Q11. ​Does divorce revoke my will?
  • No. Divorce does not automatically revoke a Will.
  • If you already have a Will, you should review and update it after a divorce to avoid unintended beneficiaries.

​Q12. Can I get a divorce at JPN (National Registration Department)?
  • No. JPN cannot grant divorces.
  • For non-Muslims, divorce can only be filed and decided in the High Court of Malaya under the Law Reform (Marriage and Divorce) Act 1976.
  • JPN’s role is mainly to register marriages and update marital status after a divorce order is issued by the court.

Q13: Can I get a divorce online in Malaysia?
  • A divorce cannot be completed entirely online, as it must go through the High Court. However, many parts of the process can be managed virtually.

Q14: Can I apply for divorce within 2 years of marriage?
  • Generally, no. Divorce cannot be filed within the first 2 years unless there is exceptional hardship
  • Not all marriages require divorce to be dissolved. In certain cases, a marriage may be declared null and void through an annulment (nullity petition) under the Law Reform (Marriage and Divorce) Act 1976. 
  • Unlike divorce, annulment has no time restriction. You can apply at any time if your marriage meets the legal grounds.

Q15. Is annulment the same as divorce?
  • No. Divorce ends a valid marriage, while annulment declares that a marriage was never valid in the first place.

Q16. What does "recognition of foreign divorce" mean? Why do I need to apply for recognition of a foreign divorce?
  • Malaysia does not automatically recognise divorces obtained in another country. Recognition is still required, even if the foreign country is a Commonwealth nation.
  • If you obtained a divorce in a foreign country (e.g., Australia, Canada, China (Mainland PRC / People's Republic of China), France, Germany, Hong Kong, Japan, New Zealand, Singapore, Sweden, Taiwan (Republic of China), Thailand, United Kingdom, United States of America), we can assist with the application to the High Court for recognition of the foreign divorce.
