Introduction

​In Malaysia, divorce does not happen automatically, regardless of how long you and your spouse have been separated. To legally dissolve a marriage, you must file a divorce petition at the High Court of Malaya in accordance with the Law Reform (Marriage and Divorce) Act 1976 (Act 164). Once the court grants the divorce order, it must then be submitted to the National Registration Department (Jabatan Pendaftaran Negara, JPN) to officially update your marital status.

When both parties are in agreement, the divorce can proceed through a Joint Divorce Petition. This approach is usually the quickest and most cost-effective option, as it avoids unnecessary disputes and lengthy contested proceedings in court.


​Who Can Apply for a Joint Divorce in Malaysia?

To proceed with a joint divorce, certain requirements must be met: -
  • The marriage has been registered for at least two (2) years.
  • Both parties mutually consent to the divorce.
  • Agreements have been reached regarding custody and welfare of children (if any), division of matrimonial property such as houses, cars, and savings, and spousal maintenance or financial support, if applicable.


​Divorce Proceeding in Malaysia: Step-by-Step

Here is the typical process when filing for a joint divorce: -

  1. Initial Consultation: Both spouses consult a divorce lawyer to confirm eligibility and review the terms of the divorce.
  2. Drafting the Petition: Your lawyer will prepare the Joint Divorce Petition, clearly recording agreements on children, property, and financial matters.
  3. Filing at the Court: The petition is filed at the Family Court of the High Court of Malaya, depending on where either spouse resides.
  4. Hearing Date Fixed: The court sets a hearing date, usually within 1–3 months. Attendance by both husband and wife is mandatory.
  5. Court Hearing: During the hearing, the judge will confirm the mutual consent of both parties. If satisfied, a Decree Nisi (provisional divorce order) will be granted.
  6. Final Order (Decree Absolute): After three (3) months, the Decree Nisi automatically becomes a Decree Absolute, which legally dissolves the marriage.

If there is no agreement, you cannot proceed with a joint divorce. A single petition divorce may be necessary.

5. Can I remarry after the divorce?

Yes. Once the Decree Absolute is granted, your marriage is legally dissolved, and you are free to remarry.
