Securing Ownership After the Individual or Strata Title Is Issued

Where a property was originally purchased before an individual or strata title was issued, further legal steps are generally required after the title becomes available. Perfection of Transfer registers the purchaser as the registered proprietor, while Perfection of Charge registers the bank's security where the purchase is financed.

Understanding POT & POC

What Is the Difference?

Ownership Registration

Perfection of Transfer (POT)

Perfection of Transfer is the process of registering the property into the purchaser's name after the individual or strata title has been issued.

  • Individual or strata title has been issued
  • Memorandum of Transfer is executed
  • Applicable stamp duty and fees are attended to
  • Transfer is presented for registration
  • Purchaser becomes the registered proprietor
Bank Security

Perfection of Charge (POC)

Where the property is financed, Perfection of Charge registers the bank's legal interest in the property as security for the housing loan.

  • Applies where financing remains in place
  • Charge documentation is prepared and executed
  • Applicable stamping is attended to
  • Charge is presented for registration
  • Bank's interest is registered against the title
Why It Matters

Why Complete POT and POC?

Here are several practical reasons why the perfection process should not be left outstanding.

Registered Ownership

POT records the purchaser as the registered proprietor in the relevant land records.

Bank Security

POC registers the bank's legal interest where the property continues to secure financing.

Future Transactions

A completed transfer can facilitate future sale, transfer, refinancing and estate matters.

Avoid Complications

Leaving the perfection process outstanding may complicate future dealings with the property.

How POC Works

Where a bank loan remains outstanding, the charge over the newly issued title is generally perfected after or together with the transfer. The relevant charge documents are prepared, executed, stamped and presented for registration.

Once registered, the bank's security interest is reflected against the property title until the financing is ultimately discharged.

04Bank's interest registered

FAQ

Frequently Asked Questions

What is Perfection of Transfer (POT)?

Perfection of Transfer is the process of registering the property ownership into the purchaser's name after the individual or strata title has been issued.

Why is Perfection of Transfer important?

POT records the purchaser as the registered proprietor and helps avoid complications in future sale, transfer, refinancing and other dealings with the property.

What is Perfection of Charge (POC)?

Perfection of Charge is the process of registering the financial institution's interest in the property as security for an outstanding housing loan after the title has been issued.

Do I need POC if I have no outstanding housing loan?

POC relates to registration of the bank's security interest. If there is no outstanding financing secured against the property, the circumstances should be reviewed to determine whether any charge registration is required.

Who handles the Perfection of Transfer and Charge?

A conveyancing lawyer is typically appointed to prepare the relevant documents, attend to stamping and coordinate registration with the relevant Land Office / Land Registry.

What happens if I do not complete Perfection of Transfer?

If POT remains outstanding, the purchaser may not yet be reflected as the registered proprietor on the title, which may complicate future dealings with the property.

Can I sell my property if POT has not been completed?

A sale may still be possible, but the transaction can become more complex because the ownership has not yet been registered in the purchaser's name.

How long does POT and POC take?

The process typically takes around 3 to 6 months, depending on the complexity of the matter and the processing time of the relevant Land Office / Land Registry and other authorities.

Can POT and POC be completed at the same time?

Yes. Where financing remains outstanding, the transfer and charge processes may be coordinated together.

Do I still need POT if my housing loan has already been fully settled?

Yes. POT concerns registration of the property's ownership into your name and remains relevant even where the housing loan has already been repaid.

What documents are commonly required?

Common documents include the developer's title issuance letter, copy of the individual or strata title, Sale and Purchase Agreement, Loan Agreement where applicable, identification documents and payment for relevant fees and stamp duty.

What happens after POT and POC are completed?

Once completed, the title will reflect the purchaser as the registered proprietor and, where applicable, the bank's registered interest in the property.
