Typical Property Transfer Process
Are Family Transfers Exempt From Stamp Duty?
Do not assume that every family transfer is automatically exempt.
Stamp duty exemptions, remissions or concessions may apply to certain transfers and relationships, but the treatment depends on the applicable law and instrument at the time of transfer.
The transaction should therefore be assessed based on the relationship between the parties, property value and current exemption rules.
What If the Property Is Still Charged to a Bank?
A family transfer can be more involved where the property is subject to an existing bank charge or financing.
Depending on the structure, the transaction may require redemption, refinancing, fresh financing, discharge and re-charge documentation, or the bank's approval to the proposed arrangement.
The transfer should not be prepared in isolation from the financing position.
