Are Family Transfers Exempt From Stamp Duty?

Do not assume that every family transfer is automatically exempt.

Stamp duty exemptions, remissions or concessions may apply to certain transfers and relationships, but the treatment depends on the applicable law and instrument at the time of transfer.

A family transfer can be more involved where the property is subject to an existing bank charge or financing.
