What Is an Annulment of Marriage?

An annulment is a legal process by which the High Court of Malaya may declare a marriage null and void.

Unlike divorce, which ends a valid marriage, annulment concerns a marriage that was either void from the outset or voidable until the court grants a decree of nullity.

Void Marriage vs Voidable Marriage

The distinction matters because the legal effect and statutory grounds are different.

Section 69

Void Marriage

A void marriage is treated as invalid from the beginning.

  • One party was already lawfully married
  • A male under 18 or a female under 16 married without special licence
  • The parties were within prohibited degrees of relationship without approval
  • The parties were not respectively male and female
Section 70

Voidable Marriage

A voidable marriage remains valid unless and until it is annulled by the court.

  • Non-consummation due to incapacity
  • Non-consummation due to wilful refusal
  • Invalid consent due to duress, fraud, mistake or unsoundness of mind
  • Mental disorder at the time of marriage
  • Venereal disease in a communicable form
  • Wife pregnant by another man at the time of marriage

Bars to Annulment

Even where a statutory ground exists, annulment is not automatic. The court will consider the circumstances and the conduct of the parties.

Conduct of the Petitioner

The court may consider whether the petitioner led the respondent to believe the marriage would continue.

Fairness

The court may consider whether granting annulment would be unjust to the respondent.

Prior Knowledge

Knowledge of certain conditions at the time of marriage may affect whether annulment is available.

Early Marriage

Can You Apply Within the First 2 Years of Marriage?

Yes. Unlike divorce, annulment is not subject to the same general two-year restriction.

That does not mean every short marriage qualifies for annulment. The marriage must still fall within one of the statutory grounds for nullity.
