What Is a Joint Divorce Petition?
A joint divorce petition is used where both spouses mutually agree to dissolve the marriage and have already reached agreement on the terms that need to be addressed. Because the material issues are settled in advance, the process is generally more straightforward than a contested divorce.
Requirements for a Mutual Divorce
Before proceeding by joint petition, both spouses should be in agreement on the divorce itself and the relevant ancillary matters.

The marriage must generally have been registered for at least two years.

Several basic documents like NRIC / Passport, Marriage Certificate, and Children's Birth Certificates are commonly required for a joint divorce petition. Additional documents may be needed depending on whether children, property or other arrangements are involved.

What if we agree to divorce but have not agreed on the children?
A joint petition requires the relevant arrangements to be agreed. If there remains a dispute over guardianship, custody, access, maintenance or another material issue, the matter should be assessed before proceeding.

The spouses should agree how the matrimonial assets are to be dealt with. The agreed terms can then be reflected in the divorce documentation.
Do we have to attend court?

How long does a joint divorce take?
The timeframe depends on preparation, filing and the court's schedule. A hearing may be fixed within a few weeks after filing, subject to the court's schedule, with additional time required afterward to process the court orders and JPN update.
What happens after the court hearing?
After the hearing, the remaining court documentation and extraction of the relevant orders will be attended to. The documents are then submitted to JPN for the marital-status update.
What if my spouse does not agree to divorce?
If one spouse does not agree, the matter does not fall within a straightforward mutual joint petition. You should obtain legal advice on the appropriate alternative process.
