Planning Ahead

Why Should You Make a Will?

A Will allows you to record how you wish your estate to be dealt with after your death and who should be responsible for administering it.

Without a valid Will, your estate may instead be administered and distributed according to the applicable intestacy laws, which may not reflect your personal intentions.

A carefully drafted Will can help you:

  • identify who should inherit your estate;
  • appoint an executor to administer your estate;
  • appoint substitute executors if necessary;
  • provide for minor children;
  • appoint guardians where appropriate;
  • create trusts for younger beneficiaries;
  • make specific gifts;
  • provide alternative arrangements if a beneficiary dies before you; and
  • give clearer instructions for the administration of your estate.
Your Instructions

What Can You Include in Your Will?

The contents of a Will should be tailored to your assets, family structure and intended arrangements rather than relying on a generic template.

Executor Appointment

Appoint the person who will be responsible for administering your estate and carrying out the terms of your Will.

Specific Gifts

Leave a particular property, sum of money, investment, item or other asset to a specified beneficiary.

Residuary Estate

Provide for the balance of your estate after debts, expenses and specific gifts have been dealt with.

Substitute Beneficiaries

Provide an alternative distribution where a beneficiary does not survive you.

Guardians

Record your intended guardianship arrangements for minor children, subject to the applicable legal principles.

Trust Provisions

Provide for assets to be retained and administered for children or other beneficiaries until an appropriate age or event.

We have prepared a detailed guide on this subject: What Can I Include in My Last Will and Testament in Malaysia?
Estate Administration

Choosing Your Executor

One of the most important decisions when making a Will is deciding who should administer your estate after your death.

The executor is responsible for carrying out the terms of your Will and dealing with the necessary estate administration process.

The executor's responsibilities may include:

  • applying for a Grant of Probate;
  • identifying and collecting estate assets;
  • dealing with banks and other institutions;
  • settling estate liabilities and expenses;
  • dealing with estate properties;
  • administering trusts where applicable; and
  • distributing the estate to beneficiaries.
Planning for Children

Guardians & Trusts for Minor Children

For parents, Will planning may involve considerably more than simply leaving assets equally to the children.

A Will may include appropriate provisions concerning guardianship and may also establish trusts so that a child's inheritance is administered until the child reaches an appropriate age.

This can be particularly useful where you do not wish a young beneficiary to receive the entire inheritance immediately upon reaching adulthood.

Depending on your wishes, trust provisions may address matters such as education, maintenance, living expenses and the age at which the remaining trust capital is ultimately distributed.

Questions Parents May Wish to Consider

  • Who should care for my children if necessary?
  • Who should manage their inheritance?
  • At what age should they receive the capital?
  • Should funds be available earlier for education or maintenance?
  • Who should act if my first-choice trustee cannot act?
  • What happens if one child predeceases me?
Your Estate

Property, Investments & Other Assets

A Will can deal with many different types of estate assets, but the legal ownership and nature of each asset should be considered before deciding how it should be dealt with.

Assets Commonly Considered

  • houses, condominiums and land;
  • bank accounts;
  • shares and investments;
  • business interests;
  • vehicles;
  • valuable personal belongings;
  • money owed to you; and
  • other assets forming part of your estate.

Not Every Asset Is Necessarily the Same

Some assets may be subject to nominations, joint ownership, contractual arrangements, trusts or other legal structures.

Accordingly, estate planning should take into account how an asset is actually owned and whether it is capable of passing under the Will.

Our Process

How Does Will Writing Generally Work?

The precise drafting process depends on the complexity of your estate and instructions, but the process generally involves the following stages.

01

Your Instructions

Provide information concerning your family, assets and intended estate arrangements.

02

Beneficiaries

Identify who should receive your estate and consider appropriate substitute arrangements.

03

Executors & Guardians

Decide who should administer your estate and, where relevant, care for minor children.

04

Draft & Review

Our lawyers prepare the Will based on your instructions for your review and confirmation.

05

Execution

The final Will must be properly signed and witnessed in accordance with the applicable formalities.

For a more detailed breakdown, see our Step-by-Step Guide on How to Write a Will in Malaysia .
Execution Requirements

Signing & Witnessing Your Will

Proper execution of the Will is an important part of the Will-writing process.

For Wills governed by the Wills Act 1959, the applicable statutory formalities concerning the testator's signature and attesting witnesses must be observed.

Witness selection should also be considered carefully because the Wills Act contains provisions affecting gifts made to an attesting witness or the spouse of an attesting witness.

For this reason, it is generally prudent to use suitable independent witnesses and to follow the advised signing procedure carefully.

Intestacy

What Happens If You Die Without a Will?

Where a person dies without leaving a valid Will, the estate is described as intestate.

For a non-Muslim estate to which the Distribution Act 1958 applies, the law determines how the intestate estate is distributed among the surviving relatives.

This means that the distribution of your estate may be determined by statutory rules rather than by your personal wishes.

There will also be no executor appointed by you under a Will. An eligible person will instead need to obtain the appropriate authority to administer the estate.

Keeping Your Will Current

When Should You Review Your Will?

A Will should reflect your current family circumstances, assets and intentions. It is therefore sensible to review it after significant changes in your life.

Marriage

Changes in marital status may have important legal and practical implications for an existing Will.

Divorce

Review appointments and gifts involving a former spouse and consider whether your estate plan still reflects your intentions.

Children

The birth of children may require changes to beneficiary, guardian and trust arrangements.

Property Purchase

Acquiring significant new property may affect how you wish your estate to be structured.

Death of a Beneficiary

You should consider whether substitute arrangements remain appropriate if an intended beneficiary dies.

Change of Executor

Review your Will if an appointed executor is no longer suitable, available or willing to act.

Information You May Prepare

  • your family details;
  • intended beneficiaries;
  • executor and substitute executor;
  • guardian preferences, where relevant;
  • properties and major assets;
  • business interests or shares;
  • foreign assets, if any; and
  • any specific gifts or special arrangements.
After Death

What Happens to the Will Later?

Making a Will is part of estate planning during your lifetime. After your death, your executor may need to obtain a Grant of Probate before dealing with certain estate assets.

The executor may then need to identify assets, deal with liabilities, transfer or sell estate properties and ultimately distribute the estate in accordance with the terms of the Will.

Proper Will drafting can therefore make the executor's eventual task clearer by recording your intended appointments and distribution arrangements.

A Will may contain guardianship provisions for minor children. The wording and arrangement should be considered in light of the applicable legal principles and the family's circumstances.

Can my children receive their inheritance at a later age?

Appropriate testamentary trust provisions may be included so that assets are held and administered for a young beneficiary until the age or event specified in the Will.

Do I need to list every single asset in my Will?

Not necessarily. The appropriate structure depends on the nature of your estate and your intended distribution. A properly drafted residuary clause may deal with estate assets that are not specifically gifted.
